Actinium is an online marketplace available at https://actinium.in/, which provides sellers
and buyers of digital assets such as Websites, iOS App, Android App, Domains. It also lists
various firms providing various digital
services such as website development, app development,
digital marketing services, so that actinium users who may be
in need of any of such services can find about various firms
engaged in that work.
This privacy policy determines how Actinium handle, collect, hold, protect, use,
disclose the “personal information” or “personal data” you provide to us or that we collect
when you use our goods and services and this also displays how you may change or make
request to us to change your personal information that we have collected.
Actinium is both the “data controller” and a “data processor” of Personal Information
and is legally responsible for how Personal Information is collected and used.
What information do we collect ?
We collect and hold your Personal Information which may include your name, email address, phone
number, Address, City, State, all the information contained in the ID proof you have submitted
to us, information relating to your business or asset and all the information that you have
shared and displayed on our platform related to the asset which you have listed on our asset.
If you use our Platform to buy or sell a digital asset, we may also collect your bank and
debit/credit card details and we may in some cases collect information related to the
determination of your credit worthiness.
We may also collect non-personally identifiable information about you (such as anonymous
usage data, IP addresses and location, browser or any other such information).
How do we collect Personal Information ?
We collect your Personal Information during the course of providing our services to you.
We may collect your information when you visit our website, when you register yourself as
buyer and seller and make your Actinium account, when you list your asset for sale and all the
information you provide while doing that both relating to you and your asset, when you
communicate with us via email or text or any other form of communication that Actinium uses.
Generally, we collect your Personal Information directly through your use of our Platform
but we may also collect your Personal Information from other people or sources if you have given
your consent.
You may also provide us other information by updating or adding information to your account,
through your communications via the discussion platform, dispute resolution, your usage
preferences or when you otherwise communicate with us regarding our Platform.
Any additional information we are required or authorised by applicable laws to collect and
process in order to authenticate or identify you or to verify the information we have collected.
This is information we receive from devices (including mobile devices) you use when you access
our Platform. This information could include the following:
Location information, including location information from your mobile device which you can
turn off through settings of your device.
Information such as statistics on your page views, traffic to and from the sites, ad data,
your IP address, your browsing history, and your web log information.

before.

investigate it and resolve your query, we make ask you for more information regarding the issue
and if u decline or fail to provide the information then it should not be reasonably expected
from Actinium to take any action on your query or complaint,
We will try to resolve your query within 30 days of complaint, however we may require longer
time depending on the situation.
Using other sites
Our Platform may contain links to other websites, platforms or applications. We are not
responsible for the privacy practices of the owners of those websites, platforms, or
applications. We recommend that you read the privacy policy of any website, platform, or
application that asks you to provide your Personal Information.
Changes to our Privacy Policy
We may need to change our privacy policy from time to time, we will try to notify you of any
major changes in the privacy policy however it is your responsibility to review our privacy
policy from time to time and be informed up to date with any changes.
6. Prohibited Content Policy
Actinium has a strict prohibited content policy.
This policy covers every form of communication between users and between user and Actinium
or its representatives in any form whatsoever, and all the content no matter the kind i.e.
brand name, business information, comments, shared or published by buyer and seller.
This is not an exhaustive list and Actinium retains the right to make changes to this banned
content as required.
i) Adult, sexual, obscene content
ii) Content related to illegal activities
iii) Spam, advertising or other commercial content, including links to such content
iv) Solicitous content
v) Racist, profane, vulgar, offensive, threatening content
vi) Political, religious or social commentary
vii) Content that is fraudulent, unverified misleading or deceptive, this includes
personal information and listing
viii) Content that refers to an Actinium dispute or investigation
ix) Content that is in any manner a violation of another party’s intellectual
property rights and copyrights
As per Actinium terms, all sellers agree when creating an account, and listing an asset,
that they own and have the rights to sell and transfer ownership of whatever is included in
a listing.
Actinium retains the right to decide what language and content meets the criteria of
being ‘Prohibited Content’ and is deemed offensive.
If any evidence is found against any user engaging in any violation of the prohibited
content policy then that will force Actinium to take strict action against such user, the
actions can contain any or all of these: delisting of the asset from the platform, temporary
suspension of the user’s account from Actinium, permanent ban of the user and the user’s
Actinium account.

7. Dispute Settlement Policy
These are the four situations in which dispute can arise and the method that can be used to
resolve the dispute :
1. Reaching an agreement through communication-
The most desired outcome and the first approach to a dispute is to recommend to both parties
that they discuss any concerns or issues between them and come to an acceptable resolution.
2. No Assets have been transferred-
If either buyer or seller do not want to continue with the sale and no assets have been
transferred, then Actinium can easily cancel a sale.
3. Assets have transferred, but payment has not been made to seller-
If assets have been transferred, but payment has not been released, then both parties must agree
to assets being returned and after they have been returned the seller must agree for the sale to
be cancelled and the buyer funds refunded before that can happen.
If either party does not agree with the return of the assets; or once returned the seller does
not believe that they are in the same state as they were transferred, then move to '4'
below.
4. Both parties do not agree that assets can be returned or payment has already been made or
seller says assets are not the same as when transferred-
In either of the situations noted above the matter is considered quite complex and quite
serious.
With both parties unable to come to some proper agreement themselves, we must remain impartial
and should step away from discussions.
We recommend that independent legal advice is taken by both parties and act on their own
accordingly.
It is important to note that if funds are held with Actinium they remain securely held with us
and will only be released as advised by any legal or law enforcement body that contacts us with
regards to a disputed sale.
