1. Refund Policy


Achievement Fee

Achievement fee will not be refunded once the transaction is successfully completed.
Even if after the sale parties get involved in a dispute, the achievement fee will not be refunded.

2. Cookies & Tracking Policy

Actinium like most websites use cookies and other tracking technologies that record certain information related to a visit or interact with a site, service, application, messaging function, and other tools and to recognize a user across devices. These technologies are commonly referred to as cookies, web beacons, unique identifiers, and similar technologies. These are further explained as below.

Cookies – Small text files placed in the memory of your browser or device when you visit a website or view a message. Cookies allow a website to recognize a particular device or browser. There are several types of cookies:

Session cookies expire at the end of your browser session and allow us to link your actions during that particular browser session.
Persistent cookies are stored on your device in between browser sessions, allowing us to remember your preferences or actions across multiple sites.
Social media cookies- These cookies are used when you share information using a social media sharing button or “like” button on a websites or you link your account or engage with our content on or through a social media site.
Web beacons are Small graphic images may be included on our sites, services, applications, messaging, that typically work in conjunction with cookies to identify users and user behaviour.
Similar technologies – Technologies that store information in your browser or device utilizing local shared objects or local storage, such as flash cookies, HTML 5 cookies, and other web application software methods. These technologies can operate across all of your browsers, and in some instances may not be fully managed by your browser and may require management directly through your installed applications or device.

We may use the terms “cookies” or “similar technologies” interchangeably in our policies to refer to all technologies that we may use to store data in your browser or device or that collect information or help us identify you in the manner described above. The type of data collected can include device type, operating system, browser type, IP address, location, URLs of referring/exit pages, device identifiers, crash data and connection type. Information is collected at install, access, update, and/ or use of our Services. IP address and/or country preference can be used to provide you with an improved and personalised Service experience. This data is used to identify you so that you can avoid having to enter your username and/ or password every time you use the site. Actinium also uses this information to develop and improve our content, products and services through customer usage. This information also enables identification and prevention of possible fraudulent activity and security assess Service functionality. This also enables Actinium to deliver content, including advertisements and third party services that may be relevant to you and to personalise your experience. To opt-out of our use of cookies, you can configure your device browser’s settings. Please note that you may not be able to opt-out of any cookies or other technologies that are “strictly necessary” for the Service. Cookies are essential to authenticated access of every page as it is required for logging in the website. By accessing and using Actinium you agree to our Cookies and Tracking Policy.

3. Copyright and IP Policy

The sellers who list their digital assets on Actinium must hold the legal right to sell the Asset and all its inclusions.
If you have a copyright to any content and it has been published by someone else, just inform us with reasonable proof and we will take the content down and will inform the users on both sides. However, Actinium Support has no means of determining once and for all who owns content. This is a matter for the legal system.
In the case of repeat offenders, we’ll suspend or ban users.

Various laws which apply to content on Actinium include the Copyright Amendment Bill, 2012.

3. Privacy Policy

Actinium is an online marketplace available at https://actinium.in/, which provides sellers and buyers of digital assets such as Websites, iOS App, Android App, Domains. It also lists various firms providing various digital services such as website development, app development, digital marketing services, so that actinium users who may be in need of any of such services can find about various firms engaged in that work.
This privacy policy determines how Actinium handle, collect, hold, protect, use, disclose the “personal information” or “personal data” you provide to us or that we collect when you use our goods and services and this also displays how you may change or make request to us to change your personal information that we have collected.
Actinium is both the “data controller” and a “data processor” of Personal Information and is legally responsible for how Personal Information is collected and used.

What information do we collect ?

We collect and hold your Personal Information which may include your name, email address, phone number, Address, City, State, all the information contained in the ID proof you have submitted to us, information relating to your business or asset and all the information that you have shared and displayed on our platform related to the asset which you have listed on our asset.
If you use our Platform to buy or sell a digital asset, we may also collect your bank and debit/credit card details and we may in some cases collect information related to the determination of your credit worthiness.
We may also collect non-personally identifiable information about you (such as anonymous usage data, IP addresses and location, browser or any other such information).

How do we collect Personal Information ?

We collect your Personal Information during the course of providing our services to you.
We may collect your information when you visit our website, when you register yourself as buyer and seller and make your Actinium account, when you list your asset for sale and all the information you provide while doing that both relating to you and your asset, when you communicate with us via email or text or any other form of communication that Actinium uses.
Generally, we collect your Personal Information directly through your use of our Platform but we may also collect your Personal Information from other people or sources if you have given your consent.
You may also provide us other information by updating or adding information to your account, through your communications via the discussion platform, dispute resolution, your usage preferences or when you otherwise communicate with us regarding our Platform.
Any additional information we are required or authorised by applicable laws to collect and process in order to authenticate or identify you or to verify the information we have collected.

This is information we receive from devices (including mobile devices) you use when you access our Platform. This information could include the following:
Location information, including location information from your mobile device which you can turn off through settings of your device.
Information such as statistics on your page views, traffic to and from the sites, ad data, your IP address, your browsing history, and your web log information.
We use cookies, web beacons, unique identifiers, and similar technologies to collect information about the pages you view, the links you click, and other actions you take when using our Platform, within our advertising or email content.

Personal information collected from other sources

We may collect your information from third party sources as well, including but not limited to all the data that is publicly available, additional contact information or any other information which is allowable under the prevailing laws.
We allow you to share information with social media sites, to connect your account with the respective social media site. Those social media sites may give us automatic access to certain personal information retained by them about you.
You control the personal information you allow us to have access to through the privacy settings on the applicable social media site and the permissions you give us when you grant us access to the personal information retained by the respective social media site about you. We may also use plug-ins or other technologies from various social media sites. If you click on a link provided via a social media plug in, you are voluntarily establishing a connection with that respective social media site.
If some situation requires you to give personal information of someone else, you must make sure that you have the authorization to share the information and should inform the said person regarding our privacy policy.

Why do we need your Personal Information ?

We only collect and use your personal information for legitimate purposes, including providing you with our services and running the platform efficiently so that it can carry out the purpose for which it exists.
In particular, we need your Personal Information to :
Run the website and to provide you our services in a workable, reasonable and practical manner;

Providing support services to you and answering any question you may have about Actinium and its services;

Ensure compliance with out contractual and legal obligation to you and to comply with the legal provisions and for investigating, reporting and preventing any illegal activity on our platform;

Improving the processes, design, features and methods by tracking, storing, observing and analysing the user activity, user preferences, and user communications;

For contacting you for marketing, informational, notice, promotion purposes through email, SMS, phone;

If you do not provide us with your Personal Information, we not be able to carry out some or all of our Purposes.

What disclosures do we make ?

We will disclose your Personal Information for our Purposes only which has been stated in detail before.
We may also disclose your personal information to any other parties when we are required and obligated by the provisions of the law to do so, or with your consent, or to our service partners or providers (including technology partners, hosting providers, payment processors, and fraud prevention service providers) in order to assist us to provide our services to you.
By providing us with your Personal Information, you acknowledge that your Personal Information may be used, stored and disclosed overseas.

Is your Personal Information confidential and secure ?

We take all reasonable steps to keep your Personal Information secure and to ensure it is protected against misuse, loss, unauthorised access, modification or inappropriate disclosure. We may keep your Personal Information in both hard copy and electronic forms, but adopt appropriate technical and organisational security measures to protect it.
You are also urged to take steps to keep your personal information safe by keeping a strong password and changing it regularly and never to share your password with others, to not allow others to access your account.

Queries and complaints

If you have any query or complaint regarding our privacy policy or any of its provision, please contact us through email at support@actinium.in
We will review your query or complaint and when possible take reasonable steps to investigate it and resolve your query, we make ask you for more information regarding the issue and if u decline or fail to provide the information then it should not be reasonably expected from Actinium to take any action on your query or complaint,
We will try to resolve your query within 30 days of complaint, however we may require longer time depending on the situation.

Using other sites

Our Platform may contain links to other websites, platforms or applications. We are not responsible for the privacy practices of the owners of those websites, platforms, or applications. We recommend that you read the privacy policy of any website, platform, or application that asks you to provide your Personal Information.

Changes to our Privacy Policy

We may need to change our privacy policy from time to time, we will try to notify you of any major changes in the privacy policy however it is your responsibility to review our privacy policy from time to time and be informed up to date with any changes.

5. Banned behavior Policy

At Actinium we expect all users to respect one another and to respect Actinium representatives.
There are certain behaviors, actions, conducts which are banned by Actinium.
Please note this behavior policy covers all activities on the Actinium platform and all forms of communication between users and with Actinium and its representatives either on the Actinium platform or in any other form of communication.
The following is not an exhaustive list and Actinium retains the right to make changes to this banned behavior list as required. Actinium retains the right to decide what behaviors meet the criteria of being unacceptable.
i) Dealing off-platform
ii)False or unverified accusations
iii)Multiple account operation
iv)Sale or transfer of Actinium account to another person
v)Involvement in fraud
vi)Abuse or threatening behavior
vii)Not fulfilling the terms of the contract between the buyer and seller
viii)Providing any false information to Actinium whether it is related to the user or the listed asset or anything else
If any evidence is found against any user engaging in any banned behavior will force Actinium to take strict action against such user, the actions can contain any or all of these: delisting of the asset from the platform, temporary suspension of the user’s account from Actinium, permanent ban of the user and user’s Actinium account.

6. Prohibited Content Policy

Actinium has a strict prohibited content policy.
This policy covers every form of communication between users and between user and Actinium or its representatives in any form whatsoever, and all the content no matter the kind i.e. brand name, business information, comments, shared or published by buyer and seller.
This is not an exhaustive list and Actinium retains the right to make changes to this banned content as required.
i) Adult, sexual, obscene content

ii) Content related to illegal activities

iii) Spam, advertising or other commercial content, including links to such content

iv) Solicitous content

v) Racist, profane, vulgar, offensive, threatening content

vi) Political, religious or social commentary

vii) Content that is fraudulent, unverified misleading or deceptive, this includes personal information and listing

viii) Content that refers to an Actinium dispute or investigation

ix) Content that is in any manner a violation of another party’s intellectual property rights and copyrights

As per Actinium terms, all sellers agree when creating an account, and listing an asset, that they own and have the rights to sell and transfer ownership of whatever is included in a listing.
Actinium retains the right to decide what language and content meets the criteria of being ‘Prohibited Content’ and is deemed offensive.
If any evidence is found against any user engaging in any violation of the prohibited content policy then that will force Actinium to take strict action against such user, the actions can contain any or all of these: delisting of the asset from the platform, temporary suspension of the user’s account from Actinium, permanent ban of the user and the user’s Actinium account.

7. Dispute Settlement Policy

These are the four situations in which dispute can arise and the method that can be used to resolve the dispute :

1. Reaching an agreement through communication-

The most desired outcome and the first approach to a dispute is to recommend to both parties that they discuss any concerns or issues between them and come to an acceptable resolution.

2. No Assets have been transferred-

If either buyer or seller do not want to continue with the sale and no assets have been transferred, then Actinium can easily cancel a sale.

3. Assets have transferred, but payment has not been made to seller-

If assets have been transferred, but payment has not been released, then both parties must agree to assets being returned and after they have been returned the seller must agree for the sale to be cancelled and the buyer funds refunded before that can happen.
If either party does not agree with the return of the assets; or once returned the seller does not believe that they are in the same state as they were transferred, then move to '4' below.

4. Both parties do not agree that assets can be returned or payment has already been made or seller says assets are not the same as when transferred-

In either of the situations noted above the matter is considered quite complex and quite serious.
With both parties unable to come to some proper agreement themselves, we must remain impartial and should step away from discussions.
We recommend that independent legal advice is taken by both parties and act on their own accordingly.
It is important to note that if funds are held with Actinium they remain securely held with us and will only be released as advised by any legal or law enforcement body that contacts us with regards to a disputed sale.

8. Policy related to different Service provider firms listed on ACTINIUM

ACTINIUM allows the firms engaged in services that may be relevant to our users such as Website development, App development, Digital Marketing firms or any other such type of firm to list themselves on ACTINIUM to enhance their reach and for the convenience of our users to meet such firms should they be in need of any such firms.
Service provider firms can list themselves on ACTINIUM after completing a registration process, which include providing documents proving the identity of the lister and other such information as asked and required by ACTINIUM.
All the rules and regulations applied to buyers and sellers of digital assets will in its entirety also be applied on these service provider firms.
However, ACTINIUM make no guarantee regarding the claims made by such firms on ACTINIUM, the users are strongly advised to conduct proper due diligence and contact them or take their services at their own risk.
